Background:

The Right of Way Certification is a form-type document that summarizes the status of required right of way including the number of parcels affected and type of acquisition agreements for the land rights acquired, effective date of the acquisition, as well as status of access control, material sites and disposal sites to be utilized for the project (if any) and status of required utility relocations, right of way clearances, airspace agreements and compliance with relocation assistance program requirements.

Reason for Recommendation:

Caltrans requires that a Right of Way Certification for a specific project on a State highway or funded with federal funds, be completed before a project can advance to the permitting or construction phase. For a local agency the certification must be executed by an individual authorized to execute the document on behalf of the agency. An individual resolution can be prepared and approved for each project, or alternatively the agency can submit a single blanket resolution authorizing a designated individual or individuals the authority to execute Right of Way certifications.
