Fiscal Impact/Change to Net County Cost: A $350,000 increase net County cost for Court Maintenance of Effort.
Background:
Reason for Recommendation: The FY 2006-07 Budget contained $180,000 in professional attorney services for attorney costs incurred for legal services outside of the existing indigent defense conflict panel contracts. The types of trials that fall into this category are special circumstances trials, namely homicide trials. There are currently three homicide trials under way (Karis, Roberson and Coyle/Henderson). This is an historically high number of cases and the cases involved extensive research and preparation.
Depending on the cumulative cost of these trials the county may be eligible for reimbursement from the State Controller if the costs exceed statutory thresholds. The Chief Administrative Office is working with Peterson Consulting to examine this threshold and the reimbursement process.
Action to be taken following Board approval: Chair to sign Budget Transfer.
