Title: District Attorney recommending Chairman be authorized to sign the Federal Equitable Sharing Agreement and Federal Annual Certification Report with the United States Departments of Justice and the Treasury for a term through September 30, 2008 to receive a share of the federal asset forfeitures to be used for law enforcement purposes in accordance with the statutes and guidelines that govern equitable sharing. District Attorney recommending Chairman be authorized to sign the Federal Equitable Sharing Agreement and Federal Annual Certification Report with the United States Departments of Justice and the Treasury for a term through September 30, 2008 to receive a share of the federal asset forfeitures to be used  for law enforcement purposes in accordance with the statutes and guidelines that govern equitable sharing.

Fiscal Impact/Change to Net County Cost:  No federal asset forfeiture purchases or expenditures are currently planned.
 
Background: This office has not received a share of any federal forfeitures for at least 10 years.  We are aware that federal asset seizures are currently occuring.  The above captioned agreement and report must be on file with the appropriate agency for the District Attorney to participate in sharing.
 
Reason for Recommendation:  The District Attorney will be able to receive a share of federal asset forfeitures and use these funds, according to prescribed guidelines, for law enforcement purposes.
