Fiscal Impact/Change to Net County Cost:
There is no Fiscal Impact to the County, as the land rights have already been acquired and were part of the original project costs.

Background:
As part of the Hwy 49 Relignment to Fowler Lane project (#73346), the County and the State of California (Caltrans) entered into a cooperative agreement that allowed for the construction of the project. The agreement provided for the County to obtain the necessary right-of-way for the new alignment of Hwy 49, which would ultimately be transfered to the State. The State would then relinquish to the County the old Hwy 49 no longer in use.

The County acquired all of the necessary land rights for this project in 1999-2001 by negotiated settlement and by eminent domain. The eminent domain case progressed through a lengthy court process which concluded in 2006. The County is now able to transfer the land rights related to Hwy 49 to the State. Once completed, the State will relinquish their land rights in the old Highway 49, located just east of the new intersection, to the County.

Reason for Recommendation:
The Grant Deed and legal descriptions have been prepared by the Department of Transportation, following the Caltrans required format for the Grant Deed, legal description and Notary Page/Certificate of Acceptance.
