RECOMMENDED ACTION:  The Planning Commission recommends the Board take the following action:  1.  Adopt the negative declaration, as prepared; and 2. Approve Z06-0028/P06-0024, based on the findings listed on Attachment 1, subject to the conditions listed on Attachment 2; and 3. Deny the requested design waivers and the required findings cannot be made.
 
 
 
Background: These applications were considered by the Planning Commission on May 24, 2007, and recommended for approval on a 3-2 vote.  The applicant was present and explained his proposal.  Several property owners in the area voiced concern regarding the one-acre zoning, as the size of the parcel would not be consistent with the existing CC&Rs for the area. During the hearing, staff commented that a change in zoning to two-acre rather than one-acre zoning would benefit the applicant, as the road improvements would be less severe.  The applicant elected to proceed with his original request, one-acre zoning on a portion of the parcel (see Exhibit A, Parcel 2), and the balance of the parcel will remain RE-5. There were no new significant issues discussed other than those in the staff report.
