Fiscal Impact/Change to Net County Cost:  No Change.  Funds were budgeted in FY 2006/07.  The remainder was included in the FY 2007/08 Proposed Budget Request.
 
Background: The County received funding in the form of two grants from the California Department of Social Services for the Child Abuse Prevention, Intervention and Treatment (CAPIT) and Promoting Safe and Stable Families (PSSF) Programs in 2006.  Funding of these two grants was contingent on obtaining a subrecipient to provide child abuse prevention, intervention, and treatment services under the CAPIT and PSSF Programs.  On October 17, 2006, the Board executed Agreement #202-S0711 with New Morning Youth and Family Services to act as subrecipient for the provision of the specified services on an as requested basis for clients of the Department of Human Services, Social Services Division during the term of October 17, 2006 through June 30, 2007.  On December 5, 2006, the Board executed Amendment I to amend the Scope of Services, Term, and Compensation for Services in order to consent to Contractors request that the Agreement be made retroactive to July 1, 2006 to allow for payment for services Contractor provided between July 1, 2006 and October 17, 2006.  On January 30, 2007, the Board executed Amendment II to amend the Scope of Service and Compensation to allow for the addition and expenditure of new Child Welfare Services Outcome Improvement Project (CWSOIP) state funds for the provision of Differential Response Program Services, a component of PSSF services.  Article IV-Program Monitoring and Statistical Reporting was added in order to comply with Path II Differential Reporting Responsibilities as they applied to CWSOIP requirements.   
 
Reason for Recommendation:  The provision of child abuse prevention, intervention, and treatment services under the CAPIT and PSSF programs continues to prove to be a successful tool to improve the lives of families served by the Department of Human Services (DHS).  Agreement for Services #202-S0711 with New Morning Youth and Family Services, Inc. expires on June 30, 2007.  Processing of an Amendment to extend the term and increase the compensation was initially delayed due to a multi-department effort to develop a standardized rate structure for similar services intended to take effect in FY 2007/08.  A request for the necessary contract Amendment was submitted to Procurement and Contracts in mid-April.  Amendment III will extend the term to December 31, 2007 and increase the compensation accordingly in order to allow the Department to continue to participate in the multi-department effort to implement a standardized rate structure during FY 07/08.  Because a further delay in processing resulted due to the time required to achieve compliance with recent changes to Board of Supervisors Policy C-17 requirements as they relate to contracts that are being amended and are over $100,000, this Amendment is being submitted retroactively.  DHS is recommending that the Board authorize execution of Amendment III to Agreement for Services #202-S0711, contingent upon receipt of required concurrences, retroactive to and effective July 1, 2007.  Approving retroactive execution of this Amendment contingent upon County Counsel and Risk Management concurrence will prevent interruption of necessary services to DHS clients.  
 
Purchasing Agent Recommendations:  The Human Services Department has contracted with New Morning Youth and Family for the provision of child abuse prevention, intervention, and treatment on an as requested" basis.  The Procurement and Contracts Division has processed Amendment III to the subject agreement.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for an increase in compensation by $78,488.00 for a total not to exceed amount of $$231,463.00, and a six (6) month term extension.  
 
In May of 2006, the Procurement and Contracts Division issued a competitive Request for Proposals for the provision of the services described hereinabove.  An evaluation team comprised of County Human Services personnel and staff from the Child Abuse Prevention Council reviewed the proposal responses.  On June 20, 2006, item #24, your Board awarded the subject RFP to New Morning Youth and Family Services.
 
The County Purchasing Agent has reviewed the department's request to contract with New Morning Youth and Family Services and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Human Services Department.
 
The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Upon receipt of required concurrences, Procurement and Contracts to provide the Board Clerk with the approved Blue Route and two (2) originals of Amendment III to Agreement for Services #202-S0711 for execution by the Chairman.  Board Clerk to return two executed copies of Amendment III to Agreement for Services #202-S0711 to Procurement and Contracts.  Auditors Office to authorize payment of future invoices.
