Fiscal Impact/Change to Net County Cost: No Change.  Funds were budgeted for FY 2005/06 and FY 2006/07.  The remainder was included in the FY 2007/08 County Budget Request.

 

Background: On June 27, 2006, the Board executed Agreement #053-S0711 with Progress House, Inc. for the provision of substance abuse testing and treatment services for eligible CalWORKs clients.

 

Reason for Recommendation: The provision of substance abuse testing and other related services continues to prove to be a successful tool to improve the lives of families served by the Department of Human Services (DHS).  Agreement for Services #053-S0711 with Progress House, Inc. expires on June 30, 2007.  Processing of an Amendment to extend the term and increase the compensation was initially delayed due to a multi-department effort to develop a standardized rate structure for similar services intended to take effect in FY 2007/08.  A request for the necessary contract amendment was submitted to Procurement and Contracts in mid-April.  Amendment I will extend the term to December 31, 2007 and increase the compensation accordingly in order to allow the Department to continue to participate in the multi-department effort to implement a standardized rate structure during FY 07/08.  Because a further delay in processing resulted due to the time required to achieve compliance with recent changes to Board of Supervisors Policy C-17 requirements as they relate to contracts that are being amended and are over $100,000, this Amendment is being submitted retroactively.  DHS is recommending that the Board authorize execution of Amendment I to Agreement for Services #053-S0711, contingent upon receipt of required concurrences, retroactive to and effective July 1, 2007.  Approving retroactive execution of this Amendment contingent upon County Counsel and Risk Management concurrence will prevent interruption of necessary services to DHS clients. 

 

Purchasing Agent Recommendations:  The Human Services Department has contracted with Progress House, Inc. for the provision of therapeutic counseling services, inpatient (residential), and outpatient substance abuse treatment, anger management, assessments, life skill classes, substance abuse testing, and other related services on an as requested basis.  The Procurement and Contracts Division has processed Amendment I to the subject agreement.

 

In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for an updated scope of work, an increase in compensation by $50,000.00 for a total not to exceed $150,000.00, and a six (6) month term extension. 

 

The Purchasing Agent has coordinated the review of the contractor's qualifications to perform the needed services with Gayle-Erbe-Hamlin, Director of Public Health.  The Purchasing Agent concurs that Progress House, Inc. has demonstrated its ability to perform the work based on prior experience with this contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  Additionally, the contractor provides similar services to other departments within the County.

 

The County Purchasing Agent has reviewed the department's request to contract with Progress House, Inc. and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Human Services Department.

 

The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by Progress House, Inc. as the department contracts with multiple local area firms to provide similar services to its clients on an "as needed" basis.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.

 

Action to be taken following Board approval:  Upon receipt of required concurrences, Procurement and Contracts to provide the Board Clerk with the approved Blue Route and two (2) originals of Amendment I to Agreement for Services #053-S0711 for execution by the Chairman.  Board Clerk to return two executed copies of Amendment I to Agreement for Services #053-S0711 to Procurement and Contracts.  Auditors Office to authorize payment of future invoices.
