RECOMMENDED ACTION:  Planning Commission recommending the Board take the following action:  1.  Adopt the negative declaration, as prepared; 2.  Approve Z06-0035 rezoning Assessor's Parcel Number 082-543-07 from Limited Multifamily-Design Control-Airport Safety District (R2-DC-AA) to Limited Multifamily Residential-Planned Development-Airport Safety (R2-PD-AA), based on the findings listed on Attachment 1; and 3. Approve PD06-0023/P06-0030, including the design waiver and adopting the development as the official development plan, based on the findings listed on Attachment 1, subject to the conditions listed on Attachment 2.
 
 
 
Background: These applications were considered by the Planning Commission on July 12, 2007, and recommended for approval on a 3-1-1 vote.  Commissioner Mathews voted no, and Commissioner Tolhurst was absent.  The original recommendation for the design waiver was for denial, as staff did not believe the required findings could be made. After discussion during the hearing, the Commission recommended approval of the design waiver, and the conditions and findings have been amended appropriately.  The only input received was from the applicants.  No new new significant issues were discussed other than those in the staff report.
