RECOMMENDED ACTION: Planning Services staff recommends the Board take the following actions:

1. Find the project is exempt pursuant to Section 15268 of the CEQA Guidelines which states that final map approvals are ministerial and do not require further CEQA review; and

2. Approve TM94-0196C subject to the conditions listed in Attachment 1, subject to the findings contained in Attachment 2.

Background: Chapter 16.72 “Amending of Final Maps” of the Subdivisions Ordinance establishes that a final map which has been recorded by the County Recorder may be modified.

The Board of Supervisors approved Tentative Map TM98-1356 in March 2005, and Unit 3 was finaled on March 29, 2005. Unit 3 is comprised of 10 lots (lots 105-114) which are located on Via Treviso Way in the El Dorado Hills area (Exhibit A). The lots have been recorded with a number of Storm and Drainage Easements (S.D.E).

The proposed correction would change a number of the easements on the recorded lots. The drainage easement along lots 106-110 would be revised to include a 25 feet wide S.D.E. across the parcels. Additionally, a Landscape and Maintenance Easement exists on lots 111, 112, and 114. The Landscape and Maintenance Easements on lots 111 and 112 would be located along the frontage of both lots. The easement on lot 114 would be a triangular portion at the southern end of the parcel. The 10 foot wide S.D.E. on lot 113 would be relocated to 114. Several of the lots would retain the existing cross drainage easements. The correction would not alter the acreages of any the lots within Unit 3 nor would the correction affect the total number of lots within Unit 3.
