Background: On September 26, 2005, the County Recorder-Clerk entered into a Memorandum or Understanding with the Department of Justice for the purpose of complying with the Electronic Recording Delivery Act of 2004 (ERDA).

Reason for Recommendation: Addendum II to the subject MOU finalizes the proportionate share of costs for development and implementation of regulations and the costs for regulations and oversight in the fiscal year 2007/2008.

The Department of Justice requires County approval of the subject addendum and returned to them no later than September 4, 2007. Because the Department of Justice did not submit the addendum to the county until late July, there was insufficient time for the Recorder-Clerk to obtain all the proper approvals and submit to your Board for approval prior to September 4, 2007. County Counsel and Risk Management have approved the addendum. In order to meet the September 4, 2007 deadline, the Recorder-Clerk requested that the Purchasing Agent execute the addendum.
