Fiscal Impact/Change to Net County Cost:The total funding for this agreement remains unchanged at $270,000 for the remainder of the contract. There is no Change to Net County Cost.
 
Background: The Mental Health Department has contracted with Merced Manor, Inc. to provide long-term, 24-hour special treatment for mentally ill adults.  Amendment I was processed to increase compensation rates and was approved by your Board on February 13, 2007.   The Procurement and Contracts Division has processed Amendment II to the subject agreement.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  Amendment II calls for a change in the contractor's name as a result of Merced Manor, Inc. being acquired by CF Merced Behavioral, LLC doing business as Country Villa Merced Behavioral Health Center.  The total not to exceed amount of the contract remains at $270,000. Amendment II also extends the term from its current expiration date of February 5, 2008 to January 31, 2009.  
 
The Purchasing Agent has coordinated the review of the new contractor's qualifications to perform the needed services with Billy Olpin, Master of Social Work, with the San Joaquin County Behavioral Health Services. The Purchasing Agent concurs that CF Merced Behavioral, LLC has demonstrated its ability to perform the work based on prior experience with this contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  Additionally, the contractor provides similar services to other Counties within the region.
 
Reason for Recommendation:The County Purchasing Agent has reviewed the department's request to contract with CF Merced Behavioral, LLC and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Mental Health Department.
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by CF Merced Behavioral, LLC as the department contracts with multiple local area facilities to provide similar services to its clients on an "as needed" basis.  Multiple contracts with treatment facilities such as this one are in place to offer specialized services based on an individual client's needs.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Procurement and Contracts will obtain signatures from the contractor.  Once signatures have been obtained by the contractor, Procurement and Contracts will forward to the Board Clerk's Office for execution by the Chair.
 
Board Clerk's Office will forward the executed Amendment I to Mental Health for further processing.
