Fiscal Impact/Change to Net County Cost:
 
Sufficient funds are available for this agenda item in the U.S. 50 / Missouri Flat Road Interchange Improvements (Phase 1B) Project, FY 07/08 budget, which is funded through the TIM.  There is no net cost to the County General Fund associated with this agenda item.
 
Background:
 
The U.S. Hwy. 50/Missouri Flat Road Interchange Project #71366 (Phase 1B), requires that a Temporary Construction Easement be acquired from the subject property owner in order to accommodate the widening of the Weber Creek Bridge (Veterans Memorial Bridge) on U.S. Hwy. 50 just east of the Missouri Flat Road Interchange and to construct the new westbound off-ramp from U.S. Hwy. 50 onto Missouri Flat Road.  The subject property consists of a commercial pad and is located on the southeastern corner of the Safeway Shopping Center.  
 
On July 18, 2006, your Board authorized DOT's Right of Way Unit to engage in negotiations to acquire temporary land rights for a portion of the subject property.  Negotiations with the owner/developer of the property, Kobra Properties, has concluded and a settlement reached that is representative of the appraised value offered to the property owner for these temporary land rights.
 
Reason for Recommendation:
 
The land rights are necessary from the subject property owner in order to widen the Weber Creek Bridge (Veteran's Memorial Bridge) and construct the new westbound off-ramp onto Missouri Flat Road from U.S. Hwy. 50.
 
Action to be taken following Board approval:
 
1.  The Board Chairman to execute the Certificate of Acceptance associated with the Temporary Construction Easement for a temporary easement affecting a portion of the subject property.
 
2.  The Board Clerk to return all executed documents to the DOT R/W Unit for final processing.
 
3.  Director of Transportation or designee to sign the escrow instructions and any related escrow documents pertaining to the transaction, including authorization for and payment to the subject property owner and title company.
