Fiscal Impact/Change to Net County Cost:  Funding for the Change Order is available in the FY 2007-08 CSA #10 proposed budget.  There is no cost to the General Fund.
 
 
Background: The closure for the 15.8-acre Class III Old Landfill at the Union Mine Disposal Site specified by the Central Valley Regional Water Quality Control Board (CVRWQCB) in new Waste Discharge Requirements Order No. R5-2006-0020 was required to be completed by August 15, 2007.  As part of the Final Closure Plan, submitted to the CVRWQCB on March 30, 2006, it was identified that 13.6 acres of the 15.8-acre Class III Old Landfill Area would receive final cover in the year 2007.  The remaining 2.2 acres are scheduled to be closed in the year 2040, the projected closure date of the Class II active disposal area.
 
The closure of the Union Mine Landfill project was divided into three components for bidding purposes.   The first component being the supplying and hauling of soil for the Vegetative Cover, the second being the supplying and installations of the Geosynthetics, and thirdly, the construction of the Final Cover.  
 
On May 8, 2007, the Board awarded a contract to Joe Vicini, Inc. of Placerville, California for the third component of the closure, the supplying and hauling of soil to construct the vegetative layer for the final cover of the 13.6-acre old Union Mine landfill area in the amount of $429,000.
 
Reason for Recommendation:  On February 13, 2007, the Board of Supervisors approved the bid documents for supplying and hauling soil for the Vegetative Cover, 13.6 Acre Class III Old Landfill Area, Union Mine Disposal Site project. On May 8, 2007, the Board of Supervisors awarded the Vegetative Cover bid to the lowest, responsive bidder, Joe Vicini, Inc.
 
The line item in the Bid Schedule for this component of the Vegetative Cover was 22,000 cubic yards.  This vegetative soil material quantity was strictly an estimate based upon the approximate square footage of the closure area without taking into consideration the slope factors, containment berms, and other potential design build aspects of the project.  In order to save costs relative to time and material that is associated with engineering fees, this project was approached from a "design build" perspective.  Through this process at least three months of engineering design work and approximately $150,000 in consulting service fees was saved.  
 
Based on F3's "As-Built" survey, the earthwork construction surveyor of record, and confirmed by the construction quality assurance survey conducted by Carlton Engineering, Inc., the in-place quantity of vegetative soil material increased to 25,990 cubic yards. This increase was primarily due to adding an additional foot of soil material on the intermediate and lower benches.  Two ten-foot wide benches were required to provide breaks in the landfill slope for linear anchor trenches and storm water drainage controls.  In addition, because the excavated material removed from the anchor trenches was not acceptable for backfilling, imported vegetative cover was utilized for the anchor trenches.  Another 2, 235 cubic yards of imported vegetative material was required to be used in the diversion drainage berms because the native soil contained numerous jagged rocks. The onsite subgrade material could not be analyzed until the "Grubbing and Scrubbing" phase of the project was completed.  Upon this phase completion, the soil was examined and the discovery of numerous jagged rocks was made. The presence of this rock posed a damage risk to the yet-to-be installed geomembrane liner.  In total, 28,225.44 cubic yards was needed to complete the Vegetative Cover.  See attachment, "Construction Memorandum" by NJF Engineering for additional information.
 
In order to meet the project deadline of August 15, 2007, as required by the California Regional Water Quality Control Board, and to avoid potential stand-by charges by related contractors, a change order was issued and signed by the Director of Environmental Management.  A delay in the project would have resulted in fines and contractor stand-by charges of up to $36,260.00 per week.  The Department is requesting the Board ratify the Director's signature on the attached Change Order request.  The Change Order specifies an additional 6,225.44 cubic yards of vegetative cover material.  This is a $121,396.08 increase to the original bid amount of $429,000, and an overall increase of 6.7% to the project cost in its entirety of $1.8 million.
 
Action to be taken following Board approval:  The Department will execute the attached Change Order.
