Background:
Initially, the Apalachee Erosion Control Project Phase 3B (Project) was included as part of the Apalachee Phase 1 Erosion Control Project, for which the Transportation Department (Department) prepared an Initial Study and a Mitigated Negative Declaration (IS/MND) to fulfill the requirements of the California Environmental Quality Act (CEQA).  Upon completion and circulation of the IS/MND, the Board approved the IS/MND on February 8, 2000 (State Clearinghouse # 99122015) and a Notice of Determination was filed on February 11, 2000.  
 
As additional physical and geographical modifications occurred to the initial Apalachee Phase 1 and Phase 2 Erosion Control Projects, Department staff concluded that it was necessary to establish a Phase 3A and Phase 3B of the Apalachee Erosion Control Project to facilitate construction and funding.  In doing so, the Department was required by CEQA to prepare an addendum to the original IS/MND for the Apalachee 3A and 3B Erosion Control Projects due to design modifications and the addition of public parcels.  This Addendum was approved by the Board on November 15, 2005.
 
The Project has been identified by the Tahoe Regional Planning Agency and the California Tahoe Conservancy as a priority water quality and erosion control project in the "Environmental Improvement Program for the Lake Tahoe Region" and "Report on Soil Erosion Control Needs and Projects in the Lake Tahoe Basin," respectively.
 
Reason for Recommendation:
As of October 1, 2007, the Department has completed Phase 3A of the Project; however, Phase 3B has yet to be completed and is scheduled for construction in the summer of 2008.  Currently, the Department is finalizing the plans for the Project, which include minor modifications and the addition of public parcels.  This Addendum for the Project is intended to satisfy the requirements under CEQA and is required due to modifications that have been made to the Project improvement designs.
 
The Initial Study will not require any changes and there are no new significant environmental effects that would require major revisions of the previous IS/MND. In addition, the adopted mitigation measures will remain the same.
 
Action to be taken following Board approval:
1. The Director of Transportation will sign the Addendum.
2. The Department will certify the Notice of Determination with the Recorder/Clerk's office.
3. The Department will submit a Notice of Determination to the State Clearing House.
4. The Department will provide the Board Clerk with a copy of the signed Addendum.
