Environmental Management Department recommending Chairman be authorized to sign a Notice of Deed Restriction for APN 092-011-20-100, 5700 Union Mine Road, Placerville, CA 95667 as imposed by the California Regional Water Quality Control Board, pursuant to the final 13.6 acre Union Mine Landfill closure specified in Waste Discharge Requirement Order No. R5-2006-0020; said property is owned by the County of El Dorado.

Fiscal Impact/Change to Net County Cost: There is no cost to the General Fund.
Background: The closure for the 15.8-acre Class III Old Landfill at the Union Mine Disposal Site specified by the Central Valley Regional Water Quality Control Board (CVRWQCB) in new Waste Discharge Requirements Order No. R5-2006-0020 was required to be completed by August 15, 2007. As part of the Final Closure Plan, submitted to the CVRWQCB on March 30, 2006, it was identified that 13.6 acres of the 15.8-acre Class III Old Landfill Area would receive final cover in the year 2007. The remaining 2.2 acres are scheduled to be closed in the year 2040, the projected closure date of the Class II active disposal area.
Reason for Recommendation: Pursuant to the completion of the 13.6 acre final closure, Waste Discharge Requirement Order No. R5-2006-0020 additionally specifies a Notice of Deed Restriction be filed and signed by El Dorado County, as the property owner, that indicates the following:
1. The parcel has been used as a municipal solid waste landfill.
2. Land use options for the parcel are restricted in accordance with the post-closure land uses set forth in the post-closure plan and in the Waste Discharge Requirements for the landfill.
