There is no Fiscal Impact associated with this item. There is no Net County Cost.

Reason for Recommendation:
The Contract for the Sawmill 1A Bike Path Project (Project) executed by the Board on May 22, 2007, was substantially completed October 16, 2007.

The Transportation Department (Department) has submitted payment requests for all undisputed Items of Work. The Department anticipates the Contractor will file a claim related to interest due in accordance with the Public Contract Code for late payments. Since punch list work has been completed and the recordation of the Notice of Completion will start legal time frames for guarantees, a lien period, and return of retention monies, the Department is recommending the Chairman be authorized to accept the Project as substantially complete and to sign and have the Notice of Completion recorded. Once final resolution of the payment is reached, the Department proposes to present the final contract amounts to the Board via the CAO's Report.

Major Contract Change Orders for this Project dealt with the additional rock dissipator, filter fence, and asphalt pavement removal, deletion of bid items associated with drainage diversions and dewatering, and a credit to the County for asphalt paving that was not in compliance with the Contract Documents.
