Background:
Assembly Bill 2766 (Sher) authorized air pollution control districts to impose up to a $4 motor vehicle registration fee to provide funds for air districts to meet responsibilities mandated under the California Clean Air Act. On March 15, 1994, by Board Resolution #79-94, the District set the fee at $4 per registered motor vehicle.

The California Health and Safety Code states that the fees shall be used to reduce air pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies necessary to implement the California Clean Air Act. The California Air Resources Board (CARB) has published a guidance document titled "Proposed Criteria and Guidelines for Use of Motor Vehicle Registration Fees.

Reason for Recommendation:
On October 25, 2005, the Board authorized Funding Agreement No. 012-DMV-05/06-11 with El Dorado County General Services Department to grant AB2766 funding in the amount of $183,450 for the SPTC Bike Trail Project. Upon a request from the General Services Department dated October 23, 2007, the first amendment to Funding Agreement No. 012-DMV-05/06-11 will extend the completion time to December 31, 2008.
