Fiscal Impact/Change to Net County Cost:  There is no increase in net County cost.  The FY 2007-08 Accumulated Capital Outlay Budget has funds budgeted for the environmental impact assessment services.
 
Background:  On June 27, 2006 the El Dorado County Board of Supervisors approved Agreement PLS-06-01 (#345-S0711) with Pacific Municipal Consultants, Inc. (PMC) in the amount of $150,000 for a term to expire July 1, 2007.  This agreement provides County Departments with environmental impact assessment services for infrastructure and capital projects on an "as needed" basis.  Included in the Scope of Services was the preparation of the environmental impact assessments for several County capital projects, including but not limited to the Green Valley Road/Lotus Road Realignment Project; Improvements to the Durock Road/Business Intersection; Improvements to the El Dorado Hills Boulevard/Brittany Road Intersection; the Pollock Pines Community Park; and the El Dorado County Animal Control Facility.  In addition, the Development Services Department has contracted with Pacific Municipal Consultants, Inc. for the provision of environmental impact assessments services on an "as needed" basis to assist the Planning division in meeting critical project review and construction deadlines.
 
As work on several of these projects was anticipated to continue past the agreement expiration date of July 1, 2007, Development Services submitted a request to the Procurement and Contracts Division on June 1 to process an amendment that would extend the term of the agreement for one year.  As part of this agreement extension process, Procurement and Contracts, County Counsel and Development Services conducted a review of the environmental impact assessment services provided by PMC on a project and task order basis.  This review required time consuming research by both County and PMC staff, and continued well past the expiration date of the original agreement.
 
As the current agreement is retroactive, compensation for services performed after June 30, 2007 and prior to the effective date of this agreement will be in accordance with all the requirements of the Original Agreement and conform to all the specifications of the applicable scope of work/task orders.  Additionally, for authorized projects with specific periods for performance, the parties agree to negotiate in good faith regarding the amendment of Task Orders for which work was authorized and begun prior to June 30, 2007, and which specified a period of performance prior to June 30, 2007 that has not been met.
 
At the September 18, 2007 Board of Supervisors meeting, the Board requested a report listing all current agreements with Pacific Mutual Consultants, Inc. (PMC), including those agreements for which PMC is a subcontractor.  That report has been provided to your Board under a separate cover from the CAO's office.  Additionally, the Department of Transportation and Development Services are currently reviewing the qualifications of potential consultants that will provide environmental review services to the County.  This process began earlier this year and was initiated to provide the County with a broader range of options for preparation of environmental documents for County projects as well as for private development projects. It is anticipated that agreements for these "as needed" services will be brought to the Board in the beginning of 2008.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for a term extension covering the period of July 7, 2007 through June 30, 2008, and does not increase the total not to exceed amount of the contract.   The total not to exceed amount of the contract remains at $150,000 for the two (2) year term.  
 
The Purchasing Agent has coordinated the review of the contractor's qualifications to perform the needed services with Steven Johnson, Architect, of the General Services Department. The Purchasing Agent concurs that Pacific Municipal Consultants, Inc. has demonstrated its ability to perform the work based on prior experience with this consultant, qualifications of the consultant, and the availability of the consultant to perform the services.  Additionally, the consultant provides similar services to other departments within the County.  
 
The County Purchasing Agent has reviewed the department's request to contract with Pacific Municipal Consultants, Inc. and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the County.  The Purchasing Agent has advised the department that a competitive request for qualifications selection process will need to be requested and initiated by the Purchasing Agent prior to the expiration of the extended term.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Reason for Recommendation:  The agreement will provide the Planning Services Division of the Development Services Department with environmental impact assessment services from Pacific Mutual Consultants, Inc. for preparation of environmental documents for County and private projects on an "as needed" basis.  These services are critical for meeting project review and construction deadlines in a timely manner.
 
Action to be taken following Board approval:  Board Chair to sign Agreement #113-S0811.  Board Clerk's Office will forward the executed agreement to Development Services for distribution.
