Fiscal Impact/Change to Net County Cost:  There is no increase in net County cost.  The approved FY 2007-08 Development Services budget includes funding for this amendment.

 

Background:  On September 19, 2006 the El Dorado County Board of Supervisors approved Agreement #407-S0711 (PLS-06-02) with EN2 Resources, Inc. (EN2) in the amount of $346,981 for a one year term to expire September 18, 2007.  This agreement provided assistance to the Planning Services Division of Development Services Department for the preparation of an Oak Woodland Management Plan (OWMP) and related tasks.  The General Plan requires the preparation of an “Oak Resources Management Plan”, currently referred to as the Oak Woodland Management Plan, pursuant to Implementation Measure CO-P.

 

The original agreement required the consultant to prepare the OWMP as set forth by the General Plan and Settlement Agreement, a fee study to implement Option B, environmental document to address CEQA requirements, and an implementing ordinance. It also included preparation for, and attendance at, a number of public workshops with the Planning Commission, Agriculture Commission and Board of Supervisors. The OWMP is designed to be the first phase of the future INRMP and will meet State Wildlife Conservation Board requirements to establish eligibility for grant funding.

 

As work on this project was anticipated to continue past the agreement expiration date of September 18, 2007, Development Services submitted a request on July 5, 2007 to the Procurement and Contracts Division to process an amendment that would extend the term of the agreement for one year.

 

After Development Services submitted the amendment request, the project continued to evolve and the desired goals and end product of the OWMP changed.  After presentation to and receiving feedback from the Board of Supervisors, EN2 submitted to Development Services a proposed amendment to the OWMP budget plan on August 6, 2007.  The request to amend the agreement was submitted to Contracts and Procurement on August 24, 2007 after review and approval by Development Services.

 

During the contract amendment process, the Purchasing Agent required that an outside review of the consultant’s qualifications be performed.  Development Services had originally coordinated an extensive outside review of the original competitive Request for Proposal (RFP) process for the Integrated Natural Resource Management Plan (INRMP) and OWMP as a combined project in June/July 2006 prior to adoption of the current contract/procurement procedures.  During that review process it was decided that EN2 was best qualified to complete the oak woodland portion of the INRMP, while SAIC was determined to be the best qualified to perform the INRMP.  However, during the summer of 2007 it was determined by the Purchasing Agent that an additional outside review of EN2’s qualifications for the OWMP was required before the proposed contract amendment could be processed.  The Purchasing Agent coordinated the review of the consultant's qualifications to perform the needed services with Steven Johnson, Architect, of the General Services Department.

 

As the current agreement is retroactive, compensation for services performed after September 18, 2007 and prior to the effective date of this agreement will be in accordance with all the requirements of the Revised Exhibit “B”, marked “Oak Woodland Management Plan Budget”.  Travel and/or mileage expenses shall be paid in accordance with Exhibit “C”, marked “Board of Supervisors Policy D-1”.

 

In accordance with Board of Supervisors Policy C-17, Section 7.4.2, 7.5, and 7.10.the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for a term extension covering the period of September 19, 2006 through September 17, 2008 and increases the amount of the contract by $96,000 for a total not to exceed amount of $442,981.  The increased funding is covered through the increased FY 2007-08 appropriation of $650,000 for the INRFP.

 

The County Purchasing Agent concurs that the continued use of this consultant is appropriate in order to avoid an interruption of needed services in order to complete the Oak Woodland Management Plan. 

 

Reason for Recommendation:  The General Plan requires the preparation of an “Oak Resources Management Plan”, currently referred to as the Oak Woodland Management Plan, pursuant to Implementation Measure CO-P.  This agreement will assist the Planning Services Division of the Development Services Department with the completion of the Oak Woodland Management Plan and related tasks.

 

Action to be taken following Board approval:  Board Chair to sign Agreement #407-S0711.  Board Clerk’s Office will forward the executed agreement to Development Services for distribution.
