Background: The County has contracted with the El Dorado Fire Safe Council for a number of years for the provision of community wildfire prevention and planning services under Public Law 106-393, the Secure Rural Schools and Community Self Determination Act. This funding for the Fire Safe Council is commonly referred to as "Title III".

The original agreement with the El Dorado County Fire Safe Council was executed on March 25, 2003, and has been amended each year as additional funding has been approved. The Agreement expired on June 30, 2007. With the FY 2006-07 Request for Proposal process, a new funding agreement was processed. However, the pending projects and balance of funds on the original agreement were not included in the new agreement. As a result, the Board is asked to authorize the Chair to execute Amendment IX to the original Agreement to extend the term through June 30, 2008.

The new contract, Agreement #639-S0711, became effective on June 1, 2007, but the Fire Safe Council had been under the impression that it became effective on March 6, 2007, the date the Board approved the agreement. Consequently, the Fire Safe Council began incurring expenses on projects in March.
