Fiscal Impact/Change to Net County Cost: The total amount of the 23-month grant is $316,612. Of the total amount $161,056 will be budgeted for use in FY 2007-08, out of which $95,000 may go to Progress House for provision of treatment services to DUI Court participants (final amount will be based on total participation rate) and $46,472 will be received by Probation Department for a part-time Probation Officer to perform probation activities. The remaining funds will be used by Public Health to run the program.  $161,056 will be budgeted in FY 2008-09.  There is no net County Cost.
 
Background:  Public Health, on behalf of the Superior Court of El Dorado County, submitted a proposal for a DUI Court grant from the California Administrative Office of the Courts, which would establish a DUI Court in the County. The purpose of the DUI Court is to reduce the rate of recidivism among DUI offenders and in the long run improve public safety and reduction in deaths, injury, property damage, crime, and costs to taxpayers. Offenders who are sentenced to and participate in DUI Court receive treatment that focuses on alcohol use as a chronic disease. On August 21, 2007 the Board approved the grant proposal in concept. A 23-month grant (09/01/07 - 07/31/09) in the total amount of $316,612 was successfully obtained.
 
Reason for Recommendation:  El Dorado County Superior Court is a recipient of this grant; however, the Alcohol and Drug Division acts as the lead agency for the program and will receive the grant money through the Memorandum of Understanding with Superior Court.  A large part of the grant money will be used for payments to Progress House, an alcohol and drug treatment agency that will be providing treatment services to DUI court participants. In addition, the grant will also fund a 0.5 Probation Officer that will work with the Alcohol and Drug Division and whose work will be dedicated to the program part time.  Public Health and Probation have a Memorandum of Understanding in which the use of the Probation Officer allocation is described.
 
The Purchasing Agent has determined that it is appropriate to dispense with outside review of the contractor's qualifications and any competitive selection processes for services performed by Progress House, Inc. as this program will be implemented on the West Slope only, and intended only for DUI offenders, leaving Progress House, Inc. as the only agency that can provide the continuum of care required to meet the needs of multiple DUI offenders.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
Action to be taken following Board approval: (a) Chair to sign the attached budget transfers, Board Clerk's Office to forward budget transfer to Auditor for posting; (b) Chair to sign three (3) copies of the Memorandum of Understanding, Board Clerk's Office to return three (3) signed copies to Department, Public Health to forward to Superior Court for signature and return one fully signed copy to Board Clerk's office thereafter; (c) Chair to sign three copies of Agreement for Services 686-PHD1107, Board Clerk's Office to return two (2) copies to Public Health, Public Health to distribute as appropriate; (d) Chair to sign the attached resolution, Board Clerk's Office to return one (1) signed copy of resolution to Probation Department.
