Reason for Recommendation: El Dorado County and the Administrative Office of the Courts (AOC) have been in negotiations over the past four years with respect to the transfer of title or responsibility of El Dorado County court facilities to the State of California.

While the discussions continue on the transfer documents, particularly with the Cameron Park facility, I wanted to communicate the Board of Supervisors adoption of the County Facilities Annual Payment (CFP) calculation as required by the Trial Court Facilities Act of 2002 (SB 1732). SB 1732 requires all courtransferredes to be transferred to the State and hold counties responsible for the operations and maintenance cost. This calculation is based on the average of actual costs incurred from 1996 through 2000. The establishes the base amount to be paid for these costs and is frozen in perpetuity. It is anticipated that legislation will be introduced in January to extend the transfer deadline that expired on July 1, 2007 and may include a modification to the CFP calculation that would include an inflationary factor. That is why it is imperative that the Board adopt this payment level and report this amount to the AOC.
