Reason for Recommendation:
Public Contract Code Sections 20395, 22035, and 22050 authorize the County in such an emergency as the Angora Fire to immediately repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts upon a 4/5 vote of its governing body.

On September 11, 2007, the Board authorized the Transportation Department (Department) to dispense with competitive bidding requirements and authorized the Director of Transportation to sign contracts to allow for the immediate performance of emergency repairs and restoration due to the limited time to install the measures and the onset of winter.

The Contract for the Angora Fire Emergency Rehabilitation Project - Zones A & B (Project) was executed by the Director of Transportation on October 2, 2007. The Project was substantially completed on November 4, 2007.
