Background:
The Contract for the Angora Creek Stream Environment Zone Restoration Project (Project) was executed by the Board on January 25, 2005. The Project was constructed in two phases under one Contract. Phase 1 was completed on November 30, 2005. In accordance with the Contract Documents, the Transportation Department (Department) transmitted a Notice of Completion letter to Hanford Applied Restoration & Conservation (Contractor) for Phase 1, which also started the first year of the two-year vegetation establishment period for Phase 1.

Reason for Recommendation:
Phase 2 construction began in June 2006 and was suspended for the winter/spring season in December 2006 with a number of outstanding punch list items and unresolved Contractor claims. The Contractor performed vegetation establishment work in the summer and fall of 2007.

Negotiations regarding the Contractor's claims resulted in the Board authorizing the Chairman to sign the Settlement Agreement and Mutual Release during Closed Session at the December 11, 2007 Boar...
