Fiscal Impact/Change to Net County Cost: None. Funding is available within the current Capital Improvements Program budget for this project.
 
Background:  The Board awarded the construction contract to YubaCon, Inc. in the amount of $671,267.40 on July 3, 2007, Agenda item #6. The Department has issued Contract Change Order No. 1, increasing the contract amount by $25, 835.00. Contract Change Order No. 2 was approved by the Board on January 15, 2008 Agenda item #8, which resulted in an increase in the contract amount by $45, 841.30 together with an extension of the contract time by eleven (11) days. Contract Change Order No. 3 would result  in an increase in the contract amount by $8,659.84 together with an an extension of the contract time by seventy-six (76) days. Action on this Change Order has become retroactive due to weather delays and the time required to resolve the final work quantities and payment amounts with the Contractor.
 
Reason for Recommendation: Key elements of Contract Change Order No. 3 include additional paving, additional ersosion control, replacement of aggregate base material along the trail shoulders, disposal of excess soil material, and the purchase of Contractor furnished signs and sign posts. Contract Change Order No. 3 also identifies credits to the County for various items that were deleted from the contracted scope of work. The extension in the contract time is a result of the inability of the Contractor to finish final work activities due to weather.  
 
Action to be taken following Board approval: The Acting Director of General Services will execute Contract Change Order No. 3 with the contractor and staff will complete the administrative process of the Change Order to the Contract.
