Fiscal Impact/Change to Net County Cost: There is no net change to county cost.
 
REASON FOR RECOMMENDATION: School Districts in California are mandated to provide special education services to children from birth through age 22.  The specific services these children receive are defined in an Individualized Education Plan (IEP).  IEPs are developed by an IEP team that typically consists of officials from the County Office of Education, school officials and the parent(s) or guardian(s) of a child.  
 
In some cases, the County Mental Health Department (MHD) participates as a member of the IEP team and mental health services are specified in a child's IEP.  This occurs when school officials make a referral to the County Mental Health Department for assessment and, in reviewing the assessment; the IEP team determines that a child needs mental health services in order to benefit from his or her special education program. In such cases, the County Mental Health Department is obligated by A.B. 3632 to provide these services.  
 
In certain instances, residential placement is the service that is provided.  When a child is eligible for special education because of "emotional disturbance", and when the child requires a 24-hour therapeutic program in order to benefit from his education program, residential placement is an appropriate option.
 
This placement at the Colorado Boys Ranch is the result of a mediated settlement between the County officials and the child's parents, and County Counsel participated in that settlement.  Colorado Boys Ranch is an is an out-of-state facility serving youth who have coexisting psychiatric, behavioral and educational problems that prevent them from successfully functioning in their homes, schools and communities.  The facility provides a number of programs and is known for its efforts with nueroplasticity-the term used to describe the ability of the brain to recover function after trauma.     
 
The services being acquired by MHD under this contract are a residential placement for a local child as specified in his IEP.  It has been written to acquire the services specified in the aforementioned settlement, as well as to complement MHD's ability to respond quickly with the unique services available from this vendor in the future, as may be appropriate.    
 
Action to be taken following Board approval:
 
1.      The Chairman of the Board will sign two duplicates of Agreement #543-S0811 with Colorado Boys Ranch.  
 
2.      The Board Clerk's Office will forward the executed amendment to the Mental Health Department.
 
3.      The Mental Health Department will forward to the Procurement and Contracts division of the Chief Administrator's Office one duplicate of the fully executed contract with original signatures, together with supporting administrative documents.
 
4.      The Mental Health Department will forward to Colorado Boys Ranch one duplicate of the fully executed amendment with original signatures.
