Fiscal Impact/Change to Net County Cost:
There would be no fiscal impact or change to Net County Costs for FY 07/08 due to identified salary savings.  The actual cost is estimated at $26,600.00 if the positions are filled by pay period 2008-11 (5/10/08) and said costs will be absorbed by the department.  
 
Background:
Probation Department's approved FY 04/05 budget reduced the Juvenile Hall Personnel Allocation for Supervising Deputy Probation Officer-Institutions (previously titled Supervising Probation Counselor) from four (4) to two (2) FTE positions.  The allocations have not been restored to regulatory levels.
 
Reason for Recommendation:
The Supervising Deputy Probation Officers-Institutions provides supervision of Juvenile Hall and the Juvenile Treatment Center, both are 24 hour/7 days a week juvenile detention facilities.  They are mandated by  Title 15, Section 1321 California Code of Regulations:  "Each juvenile facility shall:
c.) have a sufficient number of supervisory level staff to ensure adequate supervision of all staff members identified a clearly identified person on duty at all times who is responsible for operations and activities and has completed the Juvenile Corrections Officer Core Course and PC 832 training;
d.) have a clearly identified person on duty at all times who is responsible for operations and activities and has completed the Juvenile Corrections Officer Core Course and PC 832 training;"
 
Per Title 15 Guidelines: "Each juvenile facility will identify one staff (e.g., superintendent, manager, supervisor) as responsible for operations and activities during each shift.  This person must be Core trained and should possess appropriate decision making skills and have the ability to respond appropriately to emergencies.  Appropriate training is essential to the acquisition of these skills."
 
The requirement is for 24/7 supervision of all shifts at the Juvenile Detention Facilities.  At this time the graveyard shift is not covered by supervisory staff which presents a liability to the County.  Probation respectfully requests the Board approve amending the Authorized Personnel Allocation Resolution increasing allocation of Supervising Deputy Probation Officer-Institutions from six (6) to eight (8) FTEs.
