Fiscal Impact/Change to Net County Cost:  No Change.  The Agreement is funded by the Social Services allocation with required County match met primarily with non-General Fund resources.  Funds are budgeted for FY 2007/2008 and will be budgeted for FY 2008/2009.
 
Background:  The Board approved and executed Agreement #053-S0711 in the amount of $100,000 on June 27, 2006 and approved and executed Amendment I to Agreement for Services #053-S0711 on July 17, 2007, increasing the maximum compensation to $150,000 and extending the term through December 31, 2007.
 
Reason for Recommendation:  The provision of substance abuse testing and other related services has proven to be a successful tool to improve the lives of families served by the Department of Human Services (DHS).  Amendment I to Agreement for Services #053-S0711 with Progress House, Inc. expired on December 31, 2007.  Amendment II extends the term through June 30, 2009 and increases the compensation by $20,000 to $170,000.  This Amendment is being submitted for retroactive execution as a result of delays in processing necessary to incorporate the Board approved standardized rate structure that became effective January 1, 2008 and the time required to achieve compliance with Purchasing Policy C-17 requirements for contracts over $100,000.
 
Purchasing Agent Recommendations:  The Human Services Department has contracted with Progress House, Inc. for the provision of therapeutic counseling services, in-patient (residential), and outpatient substance abuse treatment, anger management, assessments, life skill classes, substance abuse testing, and other related services on an "as requested" basis.  The Procurement and Contracts Division has processed Amendment II to the subject Agreement.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this Agreement.  The amendment calls for an increase in compensation by $20,000.00 for a total not to exceed $170,000.00 and an eighteen (18) month term extension for an end date of June 30, 2009.  
 
The Purchasing Agent has coordinated the review of the contractor's qualifications to perform the needed services with Gayle-Erbe-Hamlin, Director of Public Health. The Purchasing Agent concurs that Progress House, Inc. has demonstrated its ability to perform the work based on prior experience with this contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  Additionally, the contractor provides similar services to other departments within the County.
 
The County Purchasing Agent has reviewed the department's request to contract with Progress House, Inc. and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Human Services Department.
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by Progress House, Inc. as the department contracts with multiple local area firms to provide similar services to its clients on an "as needed" basis.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Board Clerk to forward two (2) originals of executed Amendment II to Agreement for Services #053-S0711 to the Department of Human Services, Social Services Division at 3057 Briw Road.  Auditor's Office to authorize payment of future invoices.
