Background:

Reason for Recommendation:
The Department of Transportation has received an Irrevocable Offer of Dedication for road right of way and public utilities easement, situated on Tract 3 of RS #23/50, also identified as Assessor’s Parcel Number 074-300-03, being more particularly described in Exhibit A and depicted in Exhibit B of the attached Resolution. Said dedication is being made by Larry Niegel, Karen Niegel, and Robert H. Ellinghouse, Trustee of the Ellinghouse Family Trust dated October 13, 1992, and is necessary to meet the condition requirements of COC99-49. The subject property location lies south along State Highway 193, east of Penobscot Road and west of Coon Creek Road, in Greenwood.

The Department of Transportation’s staff has reviewed said offer and recommends that the Board adopt and authorize the Chairman to sign the Resolution acknowledging but rejecting said offer for road right of way and public utilities easement at this time. Authorization for recording of said offer is pursuant to Government Code Section 7050.
