Fiscal Impact/Change to Net County Cost:  There is no net change to county cost.
 
Background:  On November 15, 2007 an Individualized Education Program (IEP) meeting was held for an El Dorado County child.  The details of that plan were determined through agreement between the child's parents, their attorney, and the County.  The agreement involved placement of the child at the Colorado Boys Ranch (CBR), an out-of-state facility serving youth who have coexisting psychiatric, behavioral and educational problems that prevent them from successfully functioning in their homes, schools and communities.  
 
Applicable law requires an IEP to be implemented as soon as possible once it is agreed upon, and the child was admitted to CBR on November 30, 2007.  MHD initiated a contract request to acquire the agreed upon services the day after the IEP, on November 16, 2007.  The Department was instructed to initiate a purchase order to meet the immediate need for services until the standard professional services contract could processed and executed.
 
Reason for Recommendation:  
On April 1, 2008 the Board of Supervisors approved Agreement #543-S0811 with the Colorado Boys Ranch (CBR) which became effective upon execution.  Upon further consultation with staff in the Chief Administrative Office and County Counsel, it was determined that it would be more appropriate to amend the newly approved contract to include the services provided since November 30, 2007 than to use a purchase order for those specialized services.  This amendment modifies the contract term to be effective beginning November 30, 2007.
 
Action to be taken following Board approval:
 
1.      The Chairman of the Board will sign two duplicates of Amendment I to Agreement #543-S0811 with Colorado Boys Ranch.  
 
2.      The Board Clerk's Office will forward the executed amendment to the Mental Health Department.
 
3.      The Mental Health Department will forward to the Procurement and Contracts division of the Chief Administrator's Office one duplicate of the fully executed amendment with original signatures, together with supporting administrative documents.
 
4.      The Mental Health Department will forward to Colorado Boys Ranch one duplicate of the fully executed amendment with original signatures.
