Fiscal Impact/Change to Net County Cost:  No Change.  The Agreement is funded by the Social Services allocation with required County match met primarily with realignment resources.  Funds are budgeted for FY 2007/2008.
 
Background: On June 28, 2005, the Board executed Agreement #386-0511 with New Morning Youth and Family Services, Inc. for the provision of therapeutic counseling and other related services for Child Protective Services clients on an "as requested" basis by the Department of Human Services.  Amendment I to this Agreement clarified service parameters by removing the reference to "shelter" in Article I-Scope of Services and Article III-Compensation and added Article XXIV-Nondiscrimination to ensure Contractor's compliance with regulatory requirements of the California Department of Social Services, which provides the funding for the provision of these services.  Amendment II further refined standards used to measure performance in Scope of Services, extended the term to December 31, 2007, and increased the total compensation amount by $25,000 for a maximum not-to-exceed amount of $125,000 during the term June 28, 2005 through December 31, 2007.
 
Reason for Recommendation:  The provision of therapeutic counseling and other related services continues to prove to be a successful tool for promoting reunification of families served by the Department of Human Services (DHS).  Contracting out to local vendors continues to be the most efficient and cost effective method of delivering these services to eligible DHS clients.  This Agreement is being submitted for retroactive execution as a result of delays in processing necessary to incorporate the Board approved standardized rate structure that became effective January 1, 2008 and the time required to achieve compliance with Purchasing Policy C-17 requirements for contract amendments that are over $100,000.  County Counsel and Risk Management have approved Amendment III to Agreement for Services #386-S0511.  Copies of the Blue Route and Amendment III to Agreement #386-S0511, with the original and prior amendments thereto, are attached and on file with the Board Clerk.
Purchasing Agent Recommendations:  The Human Services Department has contracted with New Morning Youth and Family Services for the provision of therapeutic counseling services on an "as needed" basis.  The Procurement and Contracts Division has processed Amendment III to the subject Agreement.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this Agreement.  The Amendment calls for an updated scope of work, an increase in compensation by $25,000.00 for a total not to exceed $150,000.00, and a six (6) month term extension.  
 
The Purchasing Agent has coordinated the review of the contractor's qualifications to perform the needed services with Gayle-Erbe-Hamlin, Director of Public Health.  The Purchasing Agent concurs that New Morning Youth and Family Services has demonstrated its ability to perform the work based on prior experience with this contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  Additionally, the contractor provides similar services to other departments within the County.
 
The County Purchasing Agent has reviewed the department's request to contract with New Morning Youth and Family Services and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Human Services Department.
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by New Morning Youth and Family Services as the department contracts with multiple local area firms to provide similar services to its clients on an "as needed" basis.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Board Clerk to forward two (2) originals of executed Amendment III to Agreement for Services #386-S0511 to the Department of Human Services, Social Services Division at 3057 Briw Road.  Auditor's Office to authorize payment of future invoices.
