Background:
Assembly Bill 2766 (Sher) authorized air pollution control districts to impose up to a $4 motor vehicle registration fee to provide funds for air districts to meet responsibilities mandated under the California Clean Air Act. On March 15, 1994, by Board Resolution #79-94, the AQMD set the fee at $4 per registered motor vehicle.

The California Health and Safety Code states that the fees shall be used to reduce air pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies necessary to implement the California Clean Air Act. The California Air Resources Board (CARB) has published a guidance document titled "Proposed Criteria and Guidelines for Use of Motor Vehicle Registration Fees".

Reason for Recommendation:
On June 26, 2007, the Board authorized Funding Agreement No. 009-DMV-07/08-BOS with the Highway 50 Transportation Management Association to grant AB2766 funding in the amount of $26,000 for the Smart Routes to School Project. Upon request from the Highway 50 Transportation Management Association dated April 8, 2008, the first amendment to Funding Agreement No. 009-DMV-07/08-BOS will extend the completion time for the balance of $11,000 to June 30, 2009.
