Fiscal Impact/Change to Net County Cost:
Funding for the Angora 3 Erosion Control Project (Project) has been secured from the California Tahoe Conservancy (CTC).  Since the proposed improvements benefit the property owners, the owners have agreed to grant the Temporary Construction Easements (TCEs) without monetary compensation.  The $3,000.00 incurred is for Transportation Department (Department) staff costs to obtain the TCEs. There is no Net County Cost.
 
Background:
On March 21, 2006, the Board authorized the Department to negotiate with property owners within the Project area from whom easements were required.
 
Reason for Recommendation:
The Project area is located in eastern El Dorado County, in the Tahoe Basin.  The Project area is located within an existing residential development bounded to the north by Lake Tahoe Boulevard and portions of View Circle, to the northwest by the parcels west of Mt. Rainier Drive and Pyramid Circle, to the south by North Upper Truckee Road and to the east by parcels east of Mountain Meadow Drive.  Other streets in the Project area include Dixie Mountain Drive, the southern portion of Lake Tahoe Boulevard, Mt. Shasta Circle, Mt. Diablo Circle, Mt. Olympia Circle, Snow Mountain Drive, and Pyramid Court.  The Project area includes portions of Mountain View Estates Unit Nos. 1, 2, 3, 4, and 5.  The Project area is within the area of the Angora Fire of 2007 (see attached Figure A).
 
On May 20, 2008, the Board authorized the Department to advertise for construction bids for the Project.  Due to the large size and cost of constructing the Project, the area has been subdivided into two bid schedules (Schedule 1 and Schedule 2).  
 
The Project improvements consist of construction of erosion control improvements including tree removal, curb and gutter with tie-in pavement, sediment traps, drainage inlets, culverts, rock-lined channels, grass-lined swales, sod salvage and transplant, porous pavement, sediment basins, and bio-retention areas, humus, mulch, and tackifier applications.  
 
APN 033-453-25 (Rebitz)
The purpose of this TCE is to revegetate the slopes on the property.  The Department will irrigate the revegetated area for two summers following completion of the work to ensure plant establishment.  This TCE will expire on November 1, 2010.  The area of the proposed TCE is approximately 1,040 SF (see Figure B-1).
 
APN 033-466-13 (Taylor)
The purpose of this TCE is to regrade a portion of the existing dirt driveway and place asphalt concrete (AC) pavement in the driveway adjacent to the County right-of-way.  To convey runoff the Department intends to install a culvert and an AC apron in the County right-of-way across the driveway encroachment.  In order to protect the edge of the new apron and ensure that runoff does not pond adjacent to the apron, regrading and partial paving of the driveway on the property is necessary.  The area of the proposed TCE is approximately 250 SF.  The AC area will be as large as necessary to accommodate an AC apron in the County right-of way, and will not cover the entire easement area.  This TCE will expire on December 31, 2009 to allow one year for any warranty work (see Figure B-2).
 
Action to be taken following Board approval:
1) After the Chairman signs the Certificates of Acceptance for the TCEs the Board Clerk will deliver the TCEs and Certificates of Acceptance to the Recorder/Clerk's office for recordation.  
2) The Board Clerk will notify the Department when recordation has been completed.
3) Once the documents are recorded, the Department will transmit copies to the owners and the CTC.
