Fiscal Impact/Change to Net County Cost:  None.Background:  The El Dorado County Proposition 36 Program, which allows qualifying non-violent drug offenders the option of alcohol/drug treatment instead of incarceration, was implemented in July 2001 and continues to be overseen by the El Dorado County Public Health Department.  Treatment services for the Program are subcontracted out to three local non-profit agencies, EDCA Lifeskills, Progress House, Inc., and Sierra Recovery Center.  The attached Agreements with these agencies provide funding for FY 2008-09.

 

These services are entitlements, or are guaranteed to clients upon request or by court order.  As a result, the amount of service performed by these vendors is often difficult to estimate.  Therefore, contracts such as these have historically been amended numerous times in order to ensure providers are fully compensated.  The process of amending contracts is time-consuming and costly.

 

Working with County Counsel, staff developed contract language which would allow the Contract Administrator (for Public Health contracts, the Director) to modify compensation amounts (within specified limits) to ensure vendors receive payment appropriately without necessitating formal contract amendments. 

 

Per this contract language, the Director may increase or decrease the provisional amount of each contract (based upon the level of service provided by the contractor) as long as the authorized provisional compensation for that contract remains within the applicable not-to-exceed amount of that contract.   The Director will not authorize total compensation for the three contractors combined that is greater than the total of the provisional amounts for all three contractors (i.e., $157,797).  Further, the Director will not authorize compensation for any single contract that is greater than the NTE for that contract.  Should an NTE amount need to be increased to accommodate service entitlements, the Department will return to the Board to request such amendment. This approach has been used effectively during FY 07/08.

 

Reason for Recommendation:  Approval of these agreements will allow County to continue providing Proposition 36-funded Alcohol/Drug Treatment Program services, and provides the Director authority to modify provisional compensation amounts when needed, while remaining within the NTE established for each contract.

 

Action to be taken following Board approval: 

1.   Chairman to sign three originals of each of the three Agreements.

2.   Board Clerks Office to forward two signed Agreements to Public Health.

3.   Public Health to forward fully executed Agreement to Treatment Providers, distribute and file.
