Fiscal Impact/Change to Net County Cost: Carry over funds from FY 4/05 were originally budgeted for use in FY 07/08. The District Attorney's office has subsequently reduced appropriations for FY 07/08 so that these funds can be returned.
Background: Program guidelines regulate that carry over funds can be utilized in other fiscal years providing the District Attorney's office submits justification to the Insurance Commissioner requesting approval to use funds in the following fiscal year. This requirement was not met in FY 04/05 or FY 05/06. The District Attorney's office has since adhered to program regulations requesting authorization for use of carry over funds in FY 06/07, 07/08 and 08/09.
Reason for Recommendation: The District Attorney's office has been requested to return $5,465.00 in unused carry over funds from FY 04/05. This finding was due to the Department of Insurance Audit Findings conducted in April of 2008.
Action to be taken following Board approval: A claim voucher will be submitted to the Auditors Office requesting a check be issued to Department of Insurance for $5,465.00.
