Fiscal Impact/Change to Net County Cost:
Funding for this project includes General Plan Highway 50 Traffic Impact Mitigation (TIM) Fee Program funds in the amount of $16,573,517, state bond funds of $20,000,000 from the Corridor Mobility Improvement Account (CMIA), grant funds of $7,994,483 from the Congestion Mitigation and Air Quality (CMAQ) Program. CMAQ funds may be replaced with other federal funds on a dollar for dollar basis.
 
Background:
On April 22, 2008, your Board approved Caltrans Cooperative Agreement 03-ED-50 PM 0.0/2.9 (County AGMT 08-1865) defining the responsibilities, terms and conditions by which Caltrans and El Dorado County together will cause the construction of High Occupancy Vehicle (HOV) and bus lanes on US Highway 50 from Latrobe Road to the Bass Lake Grade including replacement of the mainline bridges at El Dorado Hills Boulevard/Latrobe Road. This project is Phase 1 of a larger plan to add HOV lanes to US Highway 50 from El Dorado Hills to Shingle Springs and includes extending the east bound truck climbing lane to close the gap between Latrobe Road and the base of the Bass Lake Grade.
 
Reason for Recommendation:
The El Dorado County Transportation Commission has approved an additional allocation of $2,208,000 in federal CMAQ funds for the HOV work. The allocation of this funding will be used to offset the cost of additional work at the El Dorado Hills Boulevard/Latrobe Road interchange.
 
With this added funding, the project revenue included $7,994,483 of CMAQ funds, however, the Sacramento Area Council of Governments (SACOG) has over-obligated its CMAQ funding and has facilitated a substitution of RSTP funds for the unavailable amount of CMAQ funds. SACOG is currently identifying other available fund types and amounts that may be used. The DOT has requested wording in the Agreement to permit the substitution of other funds in lieu of the allocated CMAQ funds on a dollar for dollar basis without requiring an amendment to the Agreement.
 
Counsel for Caltrans has also requested a changes in wording to clarify the responsibilities of each agency regarding the environmental documentation required to complete this project. This change states that Caltrans has completed the environmental documents for the HOV lanes and it will be responsible for any issues associated with that aspect of the project, whereas, DOT has completed the environmental documents for the El Dorado Hills Boulevard/Latrobe Road interchange improvements (the bridge replacements and the eastbound ramp modifications) and will be responsible for any issues associated with that aspect of the project.
 
Pursuant to the El Dorado County Charter, Section 210b (6), the County may enter into any contract or agreement in cases where the Agreement is with or among any other governmental entities or agencies.
 
Action to be taken following Board approval:
 
1)  The Board Chairman will sign four (4) originals of Amended Cooperative Agreement No A-1 (County AGMT 08-1685), pending County Counsel review and approval.
 
2)  The Board Clerk will forward the four (4) originals of the executed Cooperative Agreement to the DOT to send to Caltrans for approval and signature.
 
3)  A fully executed original Agreement will be returned to the Board Clerk for filing.
