Fiscal Impact/Change to Net County Cost:
The Transportation Department (Department) budgeted $60,000 for use of this Agreement in Fiscal Year (FY) 2008-09 and anticipates budgeting the remaining $140,000 in FY 2009-10 and FY 2010-11.  Funding will be provided by grants from the California Tahoe Conservancy (CTC), United States Bureau of Reclamation and United States Forest Service, Tahoe Regional Planning Agency Mitigation Funds, and Road Fund.  There is no Net County Cost.
 
Reason for Recommendation:
The Department's erosion control projects (ECP), funded in part by grants from the CTC, include revegetation and drainage improvement work to stabilize eroding slopes and drainage channels.  CTC grant guidelines require the inclusion of California Conservation Corps (CCC) labor and other cost-saving measures to be used on the projects.  The Department has contracted with the CCC to provide very flexible and cost effective labor for over fourteen (14) years for ECPs that enhance and maintain environmentally sensitive lands and waters.
 
Under this Agreement the CCC will primarily perform revegetation efforts, drainage improvement work, and repair on various ECPs but the Agreement may also be used for other County purposes.  The ECPs include, but are not limited to, Angora Creek Stream Environment Zone (SEZ) Restoration Project, Apalachee Phase 3B ECP, Angora 3 ECP, Christmas Valley 2 ECP and SEZ Project, Montgomery Estates ECP, Echo View 2 ECP, Cold Creek Fisheries Enhancement and the Sawmill 1B Bike Path Project.
 
This Agreement is for labor associated with the construction of a public work, and as such, is not for professional services.  It is therefore exempt from Government Code Section 31000 regarding contracting for professional services and Human Resources and Employee Association notification are not required.  The Agreement is for labor only and is covered under the exception set forth in Section 20395(b) of the Public Contract Code exempting competitive bidding.  Section 20395(b) authorizes the direct contracting for labor only.  
 
Action to be taken following Board approval:
1.  After the Board Chairman has signed the two originals of the Sponsor Agreement, Project Evaluation, and Agreement Addendum, the Board Clerk will return the two originals to the Department for further processing.
2.  Upon receipt, the Department will forward the partially executed originals to the CCC for signature.
3.  Upon receipt of the fully executed original from the CCC, the Department will forward it to the Board Clerk and keep a copy for its files.
