Fiscal Impact/Change to Net County Cost:  None.  Funding is included within the Proposed FY 2008-09 Budget for the Alcohol and Drug Programs Division.
 
 
Background:  El Dorado County receives funding from the California Department of Alcohol and Drug Programs in support of the OTP in El Dorado County.   OTP funds are used for the following:
 
·   Continue treatment allocation for residential services for offenders assessed to need them;
·   Provide structured relapse prevention services for sentenced offenders who complete treatment.
·   Support the El Dorado County drug court model, including dedicated court calendars with regularly scheduled reviews of treatment progress, and strong collaboration by the courts, probation and treatment.
 
Services within this contract are considered entitlements to eligible clients and must be provided to clients upon their request or by court order. Because the number of requests for services and court orders vary from month to month it is difficult to estimate the level of services that Treatment providers will be mandated to provide.  Therefore, contracts such as these have historically been amended numerous times in order to ensure providers are fully compensated.  The process of amending contracts is time-consuming and costly.
 
Working with County Counsel, staff developed contract language which would allow the Contract Administrator (for Public Health contracts, the Director) to modify compensation amounts within specified limits to ensure vendors receive payment appropriately without necessitating formal contract amendments.  
 
Per this contract language, the Director may increase or decrease the provisional amount of each contract (based upon the level of service provided by the contractor) as long as the authorized provisional compensation for that contract remains within the applicable not-to-exceed amount of that contract.   The Director will not authorize total compensation for the two contractors combined that is greater than the total of the provisional amounts for all contractors (i.e., $109,907).  Further, the Director will not authorize compensation for any single contract that is greater than the NTE for that contract.  Should an NTE amount need to be increased to accommodate service entitlements, the Department will return to the Board to request such amendment.
 
Reason for Recommendation:  Approval of these agreements will allow County to continue providing structured Alcohol/Drug Treatment Program Substance Abuse Offender Treatment Program services, and provides the Director authority to modify provisional compensation amounts when needed, while remaining within the NTE established for each contract.
 
Action to be taken following Board approval:  
1.   Chairman to sign three originals of both Agreements.
2.   Board Clerks Office to forward four signed Agreements to Public Health.
3.   Public Health to forward fully executed Agreement to Treatment Providers, distribute and file.
