Fiscal Impact/Change to Net County Cost:This three-year agreement is for the NTE amount of $300,000.  Specific funding will be identified with the issuance of each task order. There is no cost to the County General Fund.
 
Background:
Consultant Selection:  In late 2007, the County's Procurement and Contracts Office released an RFQ for the Department for a variety of transportation related disciplines. Based on the results of that RFQ, Michael Brandman Associates is fully qualified to provide the environmental support services specified in this proposed agreement.
 
The Department notified the County Procurement and Contracts Office of this proposed professional services agreement.  On April 21, 2008, that Office responded, affirming that a competitive selection process was conducted in accordance with Board of Supervisor's Policy C-16, Section 7.5, that the time period for that process has not expired, and that it verified with the outside reviewer that the consultant is qualified and able to perform the services in accordance with Section 7.10 of the same Policy.
 
Justification:  The California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) require public agencies to complete analyses of potential environmental effects associated with proposed projects. The Department of Transportation (Department) is in need of assistance with such analyses to support projects included in the County's five-year Capital Improvement Program.
 
Michael Brandman Associates has a substantial amount of experience assisting rural counties with environmental review of transportation projects and with the California Department of Transportation project development process.
 
The El Dorado County Employees Association, Local #1 has been informed of this proposed Agreement.
 
Recommended Actions:
1.  That the Board finds pursuant to Article II, Section 210 b (6) of the El Dorado County Charter that there are specialty skills required for the work performed under this Agreement that are not expressly identified in County classifications, and that the ongoing aggregate of the work performed under this Agreement is not sufficient to warrant the addition of permanent staff.
2.  That the Board approves Professional Services Agreement #AGMT 08-1715 with Michael Brandman Associates for a term of three years in the Not-to-Exceed amount of $300,000.
 
Reason for Recommendation:  This agreement will provide specialty environmental support services that will support projects included in the County's five-year Capital Improvement Projects program and other County activities as required.   
 
Action to be taken following Board approval: The Department will forward one fully-executed original agreement document to the Consultant.
