Fiscal Impact/Change to Net County Cost:  No Change.  The Agreement is funded by the Social Services allocation with required County match met primarily with realignment resources.  Funds are budgeted for FY 2008-09 and will also be included in the Department's FY 2009-10 requested budget.
 
Reason for Recommendation:  Non-Standard Agreement #805-S0811 is necessary to enable the Department of Human Services (DHS) Child Protective Services (CPS) Program to continue to access the web-based interactive child welfare management reporting system developed by the National Council on Crime and Delinquency and titled "SafeMeasures®."  SafeMeasures® provides client service delivery activity, specifically face-to-face contact information, to CPS via Management Information Systems data that is provided by the California Department of Social Services (CDSS).  
 
Immediate access to these timely reports from SafeMeasures® ensures compliance with court orders, timely CPS referrals and appropriate management and maximization of the CDSS funding allocation while helping ensure that DHS meets State and Federal Outcome Measures as required by the Welfare System Improvement and Accountability Act of 2001 (AB 636).  CDSS uses SafeMeasures® to monitor DHS compliance to AB 636 requirements.
 
County Counsel and Risk Management have approved Agreement for Services #805-S0811.  The Purchasing Agent has recommended the contract be submitted for approval to the Board because it contains nonstandard indemnity language.  Safe Measures is proprietary software developed by the National Council on Crime and Delinquency that assists DHS in multiple ways in the provision of child welfare services.  The referenced agreement is the vendor's standard agreement modified to include County contract administrator language.   The indemnity provisions protecting the County (on page 5 of the agreement) are limited to third party claims relative to copyright and associated rights of said third party.  The vendor will not indemnify the County in any other way and because the software is proprietary it cannot be purchased from any other source.  
 
Copies of the Blue Route and Agreement are attached and on file with the Board Clerk.  
 
Action to be taken following Board approval:  Board Clerk to forward two (2) originals of executed Agreement for Services #805-S0811 to the Department of Human Services, Social Services Division, at 3057 Briw Road, CA 95667.  Auditor's Office to authorize payment of future invoices.
