Fiscal Impact/Change to Net County Cost:  Funding is included in the FY 2008-09 Proposed Budget for the Alcohol and Drug Treatment Program.  There is no net County cost.
 
Background:   The Public Health Department receives funding through a multi-year agreement with the State to provide alcohol and drug treatment prevention services.  Funding is then contracted out to local agencies to provide treatment to El Dorado County residents who seek these services.  Contracts such as these have historically been amended numerous times in order to ensure providers are fully compensated as the full impact of clients seeking services through any one vendor cannot be accurately predicted at the beginning of any fiscal year.  The process of amending contracts is time-consuming and costly.
 
Working with County Counsel, staff developed contract language which would allow the Contract Administrator (for Public Health contracts, the Director) to modify compensation amounts (within specified limits) to ensure vendors receive payment appropriately without necessitating formal contract amendments.
 
Per this contract language, the Director may increase or decrease the provisional amount of each contract (based upon the level of service provided by the contractor) as long as the authorized provisional compensation for that contract remains within the applicable not-to-exceed (NTE) amount of that contract.  The Director will not authorize total compensation for all contractors combined that is greater than the total of the provisional amounts for all contractors (i.e., $1,113,844).  Further, the Director will not authorize compensation for any single contract that is greater than the NTE for that contract.  Should an NTE amount need to be increased to accommodate service requirements, the Department will return to the Board to request such amendment.
Reason for Recommendation:   Approval of these agreements will allow County to continue providing Alcohol / Drug Treatment and Prevention Program services, and provides the Director authority to modify provisional compensation amounts when needed, while remaining within the NTE established for each contract.
 
Total provisional amounts for all vendors equal $1,113,844 as outlined below:
(1) Agreement 711-PHD0308 with Progress House, Inc., in the amount of $666,730;
(2) Agreement 712-PHD0308 with Sierra Recovery Services, in the amount of $137,409;
(3) Agreement 708-PHD0308 with EDCA Lifeskills, Inc., in the amount of $118,162;
(4) Agreement 713-PHD0308 with Tahoe Youth & Family Services, in the amount of $89,068;
(5) Agreement 710-PHD0308 with New Morning Youth & Family Services, in the amount of $77,364; and
(6) Agreement 709-PHD0308 with Family Connections El Dorado, Inc., in the amount of $25,111.
 
Action to be taken following Board approval:
·      Chair to sign three (3) originals of each of six agreements.
·      Board Clerk's Office to return two originals of each of six agreements to Department.
·      Public Health to distribute as appropriate.
