Title

Hearing to consider General Plan Amendment A08-0005 to clarify and modify Transportation Measure TC-TXa (and other Measures) approved by the voters as "Measure Y" in November 1998. (Refer file 08-565, 4/22/08)

RECOMMENDED ACTION:  Planning Commission recommending the Board of Supervisors take the following action:

 

Option A:  

1.  Adopt Resolution No. ____-____ to place the proposed General Plan Amendment to TC-Xa on November 4, 2008 ballot;

 

2.  Adopt Resolution No. ____-____ approving General Plan Amendments to TC-Xb, TC-Xc, TC-Xd, TC-Xf, and TC-Xh; Tables: TC-2 and TC-3; and Implementation Measures TC-A, and TC-B, with an effective date of January 1, 2009, and only if the amendments to TC-Xa are approved by the voters; and

 

3.  Certify that the Addendum to Environmental Impact Report SCH#2001082030, dated July 19, 2004, adequately addresses the potential impacts of the amendments and that the Addendum reflects the independent judgment of the Board.

 

Option B:

1.  Adopt Resolution No. ____-____ approving General Plan amendments to TC-Xa, TC-Xb, TC-Xc, TC-Xd, TC-Xf, and TC-Xh; Tables TC-2 and TC-3; and Implementation Measures TC-A and TC-B to take effect in thirty (30) days.

 

2.  Certify that the Addendum to Environmental Impact Report SCH#2001082030, dated July 19, 2004, adequately addresses the potential impacts of the amendments and that the Addendum reflects the independent judgment of the Board.

 

Option C:

Adopt Resolution No. ____-____  to place General Plan Policy TC-Xa (without changes) on the November 4, 2008, ballot.

 

Option D:

Direct staff to take no further action on amendments to the Transportation and Circulation Element at this time and allow Policy TC-Xc to take effect on January 1. 2009.

 

Discussion:

 

Option A:

Recommendation 1:  Adoption of Recommendation 1 would place the proposed amendments to TC-Xa on the ballot for voter approval. If the voters deny the measure, Policy TC-Xc will become effective.  If the voters approve the measure, the amended Policy TC-Xa will take effect on January 1, 2009, and remain in effect until December 31, 2018, and Policy TC-Xc would not become effective because TC-Xa did not expire.

 

Recommendation 2:  Adoption of Recommendation 2 would approve the amendments to Policies related to TC-Xa.  This approval is valid 30 days after approval, but the Board Resolution will direct that the Policy amendments do not become effective until January 1, 2009, and only if the voters approve the amendments to TC-Xa in Recommendation 1.

 

Recommendation 3:  Adoption of the Addendum certifies that the Board understands that the proposed amendments to TC-Xa and related policies (from Recommendation 1 and Recommendation 2) will not result in additional environmental impacts that were not considered in the General Plan EIR and Supplement.

 

Option B:

The Board may elect to amend the General Plan without placing the proposed amendment to TC-Xa on the ballot.

 

Option C:

The Board may decide to place TC-Xa without changes on the November ballot.  This action would not require additional CEQA analysis since this Policy was addressed in the General Plan EIR.

 

Background: These amendments were considered by the Planning Commission on June 12, 2008, and unanimously recommended for approval by those Commissioners present (see Attachment 1 for proposed amendments).  Commissioners Mac Cready and Machado were absent. See Attachment 1 for the proposed amendments.

 

The only input received was from Paul Raveling representing the El Dorado Hills Citizen's Alliance.  They are in support of the amendments.
