Facilities and Fleet Services Department recommending Board authorize Purchasing Agent to sign retroactive Amendment I to Agreement 389-S0810 with Environmental Stewardship and Planning. Inc. extending the term through August 31, 2008 to provide environmental services associated with the El Dorado Trail Project (Parkway Drive to Los Trampos).

Fiscal Impact/Change to Net County Cost: None.  Amendment changes term only, extending time.
 
Background: On September 28, 2007 Facilties and Fleet Services initiated a contract process with Environmental Stewardship and Planning, Inc. (ESP) for services necessary to comply with  environmental permitting requirements established by the United States Army Corps of Engineers for work associated with the El Dorado Trail Project (Parkway to Los Trampos). The Agreement was not fully executed until December 18, 2007. In the meantime, the project was under construction and the services were performed prior to the effective date of the Agreement. The term of that Agreement was 60 days.  
 
Reason for Recommendation: Amendment I to the Agreement is necessary to compensate the contractor for additional services performed outside the term of the original agreement.   Amendment  I has been approved by County Counsel and Risk Management.
 
Action to be taken following Board approval: Purchasing Agent to sign Amendment I to Agreement No. 389-S0810 and the Board Clerk will forward  original to Facilties and Fleet Services to complete the administrative process of the contract. CAO staff to work with Facilties and Fleet Services to ensure that proper contracting processes are utilized in the future.
