Reason for Recommendation:
Public utility easements as shown on The Promontory Village No. 6, Unit 2 A final map that recorded in Book I of Subdivision Maps at Page 139, were irrevocably offered in perpetuity to the County of El Dorado in August of 2002, and accepted by the Board of Supervisors in October of 2002.

An application has been submitted by Derrek L. Lee and Christina Lee, owners of Lots 82 and 84, requesting that the County of El Dorado Board of Supervisors vacate the public utility easements that are located along the side boundary lines for Lot 82 and on the common side boundary line between Lot 82 and Lot 84, also identified as Assessor's Parcel Numbers 124-130-19 and 124-130-54.  Said easements are more particularly described in Exhibit A and depicted in Exhibit B of the attached Resolution.

The subject properties are situated on Plio Court, east of the Sacramento-El Dorado County line, west of El Dorado Hills Boulevard and north of US Highway 50, in El Dorado Hills. Said action is necessary to accommodate construction of improvements on the subject lots.

All utility companies that could be impacted by this vacation have provided the Department of Transportation with written notification that they have no facilities within the subject areas and have no objection to the proposed abandonment.  All other existing easements will remain.  The Department of Transportation's staff has reviewed the request and has no objection.

Action to be taken following Board approval:
1)  The referenced Resolution herein will be recorded.

2)  A copy of the recorded Resolution will be sent to the property owners.

3)  A Certificate of Correction may be recorded.
