Fiscal Impact/Change to Net County Cost:
The cost associated with the construction phase of this project is estimated at $118,000, which includes an estimated bid of $79,100, supplemental items at $4,000, construction management, materials testing, and survey costs of $23,200 and a contingency of $11,700.
 
All costs associated with this project are funded through the Accumulative Capital Outlay (ACO) fund managed by the Facilities and Fleet Services Department.  This project is funded with a combination of ACO revenues and a general fund contribution.  These funds have been included in the proposed FY 2008-09 budget.
 
Background:
On July 1, 2008 your Board approved the Specifications and authorized advertisement for construction bids for the Pedestrian Access Improvements Project with the bid opening scheduled for August 7, 2008.
 
Reason for Recommendation:
The El Dorado County Senior Center Pedestrian Access Improvements Project is a mitigation measure for the new Senior Center in El Dorado Hills.  Due to staff constraints, the Facilities and Fleet Services Department requested Department of Transportation (DOT) design and oversee construction of these improvements.  The improvements consist of the installation of a sidewalk along the entire frontage of the Senior Center adjacent to Lassen Lane, ramps in compliance with the Americans with Disabilities Act (ADA), a crosswalk for the west leg of Lassen Lane, and count down pedestrian heads at the southwest and northwest corners of Lassen Lane at El Dorado Hills Boulevard.
 
As the County is eager to move this project forward in an expeditious manner, this item has been prepared prior to the receipt of the actual project bids in an effort to comply with Board item processing procedures and to meet the project delivery schedule.  The Department is scheduled to receive sealed bids for this project on Thursday, August 7, 2008 at 2:00 p.m.  The Department will open and read all bids received at that time in conformance with contract bidding requirements. The Department will subsequently review the bids and prepare a recommendation regarding award of the Construction Contract to the lowest responsive, responsible bidder and provide the Board with that recommendation via a supplemental staff report on or before the August 12, 2008 Board of Supervisors meeting.
 
Pursuant to Special Provisions Section 5-1.14, "Payments," of the Contract Documents and the State of California Standard Specifications Section 9-1.06, "Partial Payments," the County shall retain ten percent (10%) of the value of work done from each Contractor payment as security for the fulfillment of the contract.  Alternatively, pursuant to the State of California Standard Specifications Section 9-1.065, "Payments of Withheld Funds," and pursuant to Public Contract Code Section 22300, the Contractor may request that payment of retentions earned be made directly to an Escrow Agent.  The Contractor shall receive the interest earned on the investment.
 
In accordance with these provisions, the Contractor may request in writing that the County make payment of retention funds directly into an escrow account, which would necessitate an Escrow Agreement.  To help expedite this process if requested by the Contractor, the Department requests that the Board authorize the Director of Transportation to execute the Escrow Agreement.  Upon satisfactory completion of the contract and upon written notification from the Director of Transportation, the Contractor shall receive from the Escrow Agent all retention paid into the account and any interest earned thereon.
 
Action to be taken following Board approval:
1.  The Department will forward the approved Construction Contract to the lowest responsive, responsible bidder for their signature.
2.  The Department will return the signed Construction Contract, together with the required bonds, insurance, and County Counsel approval, to the Clerk of the Board for the Board Chairman's signature of the contract.
3.      Upon receipt of fully executed Construction Contract, the Department will issue a Notice to Proceed to the lowest responsive, responsible bidder.
4.      Upon approval of the recommendation, the Director of Transportation will sign the Escrow Agreement, if requested by the Contractor and in accordance with Public Contract Code Section 22300. The Department will make retention payments to the Escrow Agent and after satisfactory completion of the contract, the Director of Transportation will make written notification to the Escrow.
