Fiscal Impact/Change to Net County Cost: There is no change in Net County Cost.  Funding has been budged in CSA #10.
 
Background:  On December 12, 2006, the Board approved the Chairman executing agreement 004-A-06/07-11 with Owen Engineering and Management Consultants, Inc., to provide engineering services on an as-needed basis related to the Union Mine Wastewater Treatment Facility.
 
On December 11, 2007, the Board approved the Chairman executing the First Amendment to agreement 004-A-06/07-11 with Owen Engineering and Management Consultants, Inc., extending the term one year and acknowledging a name change from Owen Engineering and Management Consultants, Inc. to Owen Psomas Inc.
Reason for Recommendation:  The Environmental Management Department requests the Board authorize this Second Amendment with Owen Psomas Inc. for specialized engineering services related to the Union Mine Wastewater Treatment Facility.  This Second Amendment  allows for an  increase in compensation of two hundred thousand dollars and a term extension of two years.
 
The Department continues to work with Owen Psomas to secure a final discharge permit with the El Dorado Irrigation District (EID).  In addition to the permit work, the Department is in the process of working with Owen Psomas concerning plant efficiency improvements.  The engineering concerning the plant improvements is fluid and largely based upon the on-going negotiations with EID concerning the permit requirements.  The final permit requirements could have a significant impact in the day-to-day operations of the Union Mine Wastewater Treatment Facility, resulting in additional engineering services.
 
This Second Amendment has been approved by both County Counsel, Risk Management and the Purchasing Agent.  
 
Action to be taken following Board approval:  Upon execution by the Chair, the Board Clerks Office will forward copies of the amendment to Environmental Management for distribution, encumbrance, and administration.
