Title: Supervisor Baumann recommending the Chairman be authorized to sign a letter of support for Assembly Bill AB 844 (Berryhill) which proposes new requirements for the purchase of nonferrous metals by junk dealers and recyclers by requiring said dealers to keep specified information regarding the seller and the material being purchased, a thumbprint of the seller, and imposing payment by mail or after a three-day waiting period. Supervisor Baumann recommending the Chairman be authorized to sign a letter of support for Assembly Bill AB 844 (Berryhill)  which proposes new requirements for the purchase of nonferrous metals by junk dealers and recyclers by requiring said dealers to keep specified information regarding the seller and the material being purchased, a thumbprint of the seller, and imposing payment by mail or after a three-day waiting period.
RECOMMENDED ACTION:  Approve.

Supervisor Baumann requests Board authorize Chairman to sign letter of support for AB 844 (Berryhill) which proposes new requirements for the purchase of nonferrous metals by junk dealers and recyclers.  By requiring junk dealers and recyclers to keep specified information regarding the seller and the material being purchased, a thumbprint of the seller, and imposing payment by mail or after a three-day waiting period, it is the intent of AB 844 to make metal theft less appealing as well as assist law enforcement in investigating metal theft.
 
AB 844 also contains language that would deem an ordinance adopted by a city or county as not in conflict with the proposed provisions if the ordinance is passed by a two-thirds vote of the City Council or Board of Supervisors and can demonstrate by clear and convincing evidence that the ordinance is both necessary and addresses a unique problem within that jurisdiction.
 
AB 844 is sponsored by the California Farm Bureau Federation and supported by a lengthy list of law enforcement, local government, agricultural, utility and construction organizations.
