Fiscal Impact/Change to Net County Cost:
There is no cost to the County General Fund associated with this agenda item.
Reason for Recommendation:
The Amendment is necessary to correct a typographical error in the stated compensation amount in Article 4 of the Agreement. The compensation amount in the executed Agreement was $535,505 this Amendment I will correct the amount to $153,505. All other contract documents including Exhibit A to the contract and the Payment and Performance Bonds indicate the correct amount. In accordance with Dave Livingston's guidance on this matter, the Department put the Contractor on notice of the pending amendment by sending a certified letter to the Contractor on September 15, 2008.
Action to be taken following Board approval:
1. The Board Chairman will sign two originals of Amendment I to Construction Contract # GS-08-1019 with Cindy Bales Engineering, Inc.
2. The Board Clerk will forward one original of the fully-executed Amendment to the Department for further processing.
