Fiscal Impact:

The Disadvantaged Business Enterprise program administration cost is incorporated into overhead rates, and indirectly funded through the capital program. This change in DBE requirements does not increase cost over the prior requirements.

Net County Cost:

There is no cost to the County General Fund.

Reason for Recommendation:

Your Board, on June 6, 2006, approved Resolution 160-2006 replacing the County's DBE Program with the Caltrans DBE Program. The Board also approved the DBE Race-Neutral Implementation Agreement (AGMT 06-1105) and the DBE Annual Submittal Form (AGMT 06-1123).

The Caltrans Civil Rights Program modified the Caltrans DBE Program to include the identical language of the Federal Code of Regulations, 49 CFR, Part 26.51, therefore, the County is required to amend Section V of the DBE Race-Neutral Implementation Agreement with Caltrans to incorporate this change. This Amendment provides more specifics as to the responsibilities of Caltrans and the County should Caltrans fail to meet their specified DBE goal. All other terms and conditions of the Agreement remain the same.
