Fiscal Impact/Change to Net County Cost: Funding of $80,000 is included in the AQMD budget.

Reason for Recommendation: The Environmental Management Department/AQMD has utilized the legal services of Dongell Lawrence Finney, a Limited Liability Partnership for the past two years for support related to Naturally Occurring Asbestos (NOA) in El Dorado County. This support has included specialty research, review, analysis, and application of environmental law as it applies to the naturally occurring asbestos deposits and disturbance thereof, protection of ordinance and subsequent new rules. This contract allows for the continued legal and legislative support related to NOA.

The Department recommends the Board make findings that in accordance with County Charter Article II Section 210 b(6) that it is appropriate to obtain an outside contracto for the provision of specialty research and advisory services regarding Natrurally Occurring Asbestos.

Action to be taken following Board approval: Upon execution by the Chair, the Board Clerk’s Office will forward copies of the Agreement to the Environmental Management Department/AQMD for distribution, encumbrance, and administration.
